1. Our Commitment to Copyright Law

Trading Ark respects the intellectual property rights of others and expects all members and users to do the same. This policy explains how Trading Ark handles copyright infringement claims under the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.

2. Trading Ark Content Is Protected

All content created and published by Trading Ark — including but not limited to our proprietary TradingView indicator, signal posts, live session recordings, educational materials, written guides, graphics, logos, website content, and Discord community content — is protected by United States copyright law and may constitute protectable trade secrets under the Defend Trade Secrets Act (18 U.S.C. § 1836).

Unauthorized copying, reproduction, redistribution, resale, or commercial exploitation of any Trading Ark content is strictly prohibited and constitutes copyright infringement and/or trade secret misappropriation.

If you become aware of any unauthorized distribution of Trading Ark content on any platform, please report it immediately to: officialtradingark@gmail.com

3. Reporting Copyright Infringement — DMCA Takedown Notice

If you believe that content on thetradingark.com, our Discord server, or any other Trading Ark platform infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent.

4. Requirements for a Valid DMCA Takedown Notice

To be valid and actionable, your DMCA takedown notice must include all of the following:

1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner
2. Identification of the copyrighted work you claim has been infringed — if multiple works are covered by a single notice, a representative list is acceptable
3. Identification of the material you claim is infringing and information reasonably sufficient to allow Trading Ark to locate the material, including the specific URL or location
4. Your contact information including your full name, mailing address, telephone number, and email address
5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner

Notices that do not include all of the above elements may not be acted upon. Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.

5. Our Response to Valid DMCA Notices

Upon receipt of a valid and complete DMCA takedown notice, Trading Ark will:

• Promptly review the notice to confirm it is complete and valid
• Remove or disable access to the allegedly infringing content as appropriate
• Notify the member or user who posted the content, if applicable
• Maintain a record of the notice and action taken

6. Counter-Notification

If you believe that content you posted was removed as a result of a mistake or misidentification, you may submit a DMCA counter-notification to our designated copyright agent.

A valid counter-notification must include:

1. Your physical or electronic signature
2. Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
4. Your full name, mailing address, telephone number, and email address
5. A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located, or if your address is outside of the United States, the Federal District Court for the Northern District of Ohio, and that you will accept service of process from the person who provided the original DMCA notice or their agent

Upon receipt of a valid counter-notification, Trading Ark may restore the removed content within 10 to 14 business days unless the original complainant notifies us they have filed a court action seeking a court order to restrain the alleged infringement.

7. Repeat Infringers

Trading Ark maintains a policy of terminating the accounts of members and users who are determined to be repeat copyright infringers, in appropriate circumstances and at Trading Ark's sole discretion, in accordance with 17 U.S.C. § 512(i).

8. Reporting Unauthorized Distribution of Trading Ark Content

If you see Trading Ark content — including our indicator, signals, educational materials, or any other content — being shared, sold, or distributed without authorization on any platform including Discord, Telegram, Reddit, TikTok, Instagram, YouTube, X (Twitter), Whop, Gumroad, or TradingView, please report it to us immediately:

• The platform where you found the content
• A link or screenshot showing the unauthorized content
• A description of what is being shared

We actively pursue unauthorized distribution of our content and take all reports seriously.
